- Any reference in these terms and conditions to S tandard Commercial Limited (the "Company") shall include any representative appointed as its agent to provide any part of the services.
- The word ‘customer’ shall mean any person who having control of or driving a vehicle uses the parking areas and shall include his servants, agents, contractors’, licensees or any person authorised or appearing to be authorised to act on his behalf or representing him.
- ‘Vehicle’ shall mean any mechanically propelled device on wheels, but excludes trailers, caravans and vehicles whose height exceeds any restriction at the parking areas controlled by the Company.
- Parking areas shall mean any parking areas controlled by the Company.
- Words in the singular shall include the plural and vice-versa; - words importing one gender shall include the other gender.
- The Company provides only a place to park in return for payment and cannot guarantee the security of customers’ vehicles and their contents. The Company does not accept liability for any damage to or loss of vehicles or their contents, which is the result of acts or omissions outside the reasonable control of the Company or its contractors.
- Customers are strongly advised to secure and lock their vehicles and remove all possessions. The Company will take no responsibility for any loss or damage.
- In the case of damage to or theft from a vehicle whilst in the parking areas customers are advised to notify their Insurers and the police promptly. The Company does not accept any liability whatsoever in respect of loss or damage due to theft or vandalism.
- Customers should report any incident in the parking areas to the telephone numbers shown on signs displayed at the parking areas.
- If a customer damages the property of a third party or the Company, the customer must report the incident immediately to the telephone numbers shown on signs displayed at the parking areas, supplying details of the damage.
- The Company shall not be liable in respect of any death, personal injury, loss or damage sustained by any person entering a parking areas howsoever the same may be caused, unless caused by the negligence of or breach of statutory duty by the Company.
- Customers are asked to drive carefully and obey any directions given by signs, markings, or staff. After parking, customers and their passengers are asked to make their way directly to the nearest exit and proceed to the street.
- Every vehicle, together with accessories and equipment or any articles contained in or on the vehicle is only accepted by the Company subject to a lien for all the Company’s charges accrued and accruing; such lien to be in existence whenever the vehicle is in the Company’s possession notwithstanding that it may previously from time to time have been removed out of the Company’s possession.
- Customers paying the parking permit tariff must pay all sums due in advance through our web site at www.standcomm.com.
- Permits issued by the Company or its management contractor must be displayed on the passenger side of the vehicle’s windscreen or near side if you use a motorbike. You are responsible for making sure that the permit can be seen clearly at all times.
- The Company reserves the right to nominate specific bays for use by stored vehicles.
- When any amount due to the Company is not satisfied within 14 days from the date upon which the Company gives notice to a registered keeper at his last known address, the vehicle may be sold and the proceeds of sale applied towards satisfying all sums owing together with the expenses of the sale. In connection with such sale the Company shall be entitled to charge the reasonable or usual selling commission (including garage charges) whilst the vehicle is in the Company’s possession and take any action available to recover debts not discharged in this way.
- The Company reserves the right to refuse admission to any or all of its parking areas particularly in the case of vehicles carrying dangerous loads or livestock.
- The customer agrees to indemnify the Company in respect of any claim made by a third party arising out of the negligence of the customer.
- The customer shall not at any time tow any vehicle into the parking areas nor shall he, his servants, or his agents effect any repairs, renovations, additions or alterations, to any vehicle whilst it is parked in the parking areas.
- The customer shall not at any time at the parking areas sell, hire, exhibit for sale or conduct any negotiations whatsoever in respect of any vehicle accessories and equipment or any articles contained in or on the vehicle.
- Unless otherwise specified in writing any permit issued by the Company is not transferable.
- A permit shall not entitle the customer unless otherwise specified in writing by the Company to any particular space in the parking areas nor to priority over other customers. A permit shall remain the property of the Company to which it shall be surrendered on expiration.
- In default of production of a permit the Company will refuse to release the vehicle until customer identification is ascertained and a lost permit declaration completed by the customer.
- In the case of regular default of production of a valid permit, the Company shall have the right to charge the customer for the parking, without refund. The Company reserves the right to review each case on its individual merits.
- Any customer who loses their permit shall be charged at the full monthly rate for any replacement permit issued.
- Any person, who enters a Company parking areas in a vehicle and parks, is liable to pay the permit charges in full.
- Failure to comply with any of the above Terms and Conditions may result in your vehicle being served with a Penalty Notice, and/or be Clamped, and/or Removed. Clamped or Removed vehicles will be subject to a release fee at the rate applicable at the time.
- These Terms and Conditions supersede all previous terms and conditions.
